For brands following the #TikTokupdates, we are, too. TikTok's parent company, ByteDance, appealed a U.S. divestment ban this week in Washington. Filed on First Amendment grounds, its lawsuit argues that the U.S. ban singles out this China-based media company on unconstitutional grounds. The company further argues that divesting technologically is not possible, citing the law leaves them no choice but to terminate operations in the U.S. by January 19, 2025, if this ban is not reversed. Rep. Raja Krishnamoorthi, an Illinois Democrat relevant to the case, responded, “This is the only way to address the national security threat posed by ByteDance’s ownership of apps like TikTok. Instead of continuing its deceptive tactics, it’s time for ByteDance to start the divestment process." For brands who have found success on the video-based app, our recommendation is to stay put, and keep calm, but always remember to diversify your platforms.
