Fear of patient lawsuits and government fines could keep hospital systems from reporting ransomware attacks, according to Scripps Health President and CEO Chris Van Gorder, EMT, MPA, FACHE. Speaking on an American Hospital Association podcast, Van Gorder said "[Healthcare leaders are] afraid that either a comment they make will be used against them by a government agency or, somehow, be used by class-action lawyers or in any way, have repercussions for being transparent." New changes to the Health Breach Notification Rule (HBNR) expand the number of entities it covers and broaden the definition of breaches of health consumer data. The Federal Trade Commission’s HBNR requires vendors of personal health records and related entities not covered by the Health Insurance Portability and Accountability Act (HIPAA) to notify the FTC, individuals, and others of health data breaches involving identifiable health information. In the two most significant changes to the rule, the FTC widened the definition of its covered entities to include websites and applications that are not subject to HIPAA and declared that all unauthorized disclosures of consumer health data—even intended ones—are breaches and require notifications. Healthcare organizations are having a hard time recruiting and retaining qualified cybersecurity professionals, according to the 2023 HIMSS Healthcare Cybersecurity Survey. In the survey of 229 healthcare cybersecurity professionals, 74.2% of respondents identified recruitment as a significant challenge. Nearly half of respondents (47.2%) cited a lack of experience or skills among applicants and 42.8% said their organizations lacked the budget to hire qualified professionals. Non-competitive compensation was another problem, according to 28% of those surveyed.
