Crowell Secures $131 Million Trial Win for Lockheed Martin in C-5 Aircraft Case

The Armed Services Board of Contract Appeals ruled in favor of Crowell & Moring client Lockheed Martin in the C-5 Reliability Enhancement and Re-engineering Program dispute (Appeal of Lockheed Martin, ASBCA No. 62209), holding that Lockheed Martin is entitled to $131,888,860 plus interest under the Contract Disputes Act. The decision follows a four-week bench trial in October 2022.

11th Circuit Grants Preliminary Injunction in Fearless Fund, Halting Privately-Funded Grant Program Promoting Black-Female Owned Businesses

On June 3rd, 2024, in a 2-1 ruling, the 11thCircuit U.S. Court of Appeals granted a preliminary injunction against Fearless Fund (“Fearless”), enjoining the Fearless Strivers Grant Contest, a privately-funded grant competition open only to businesses owned by black women.  In another victory for the American Alliance for Equal Rights (“Alliance”) and Edward Blum, the legal strategist behind the Supreme Court’s recent rulings against college race-based admissions, the 11thCircuit held that the Alliance had standing to sue on behalf of three pseudonymously named business owners who were “ready and able” to enter the Contest but “were excluded from the opportunity to compete . . . solely on account of the color of their skin.”  The Court determined that plaintiffs were likely to prevail in the lawsuit, finding that privately funded businesses like Fearless can violate 42 U.S.C. § 1981, originally enacted as Section 1 of the Civil Rights Act of 1866, through contract-based programs restricted to persons of color.

US Supreme Court Holds Insurer With Financial Interest in Bankruptcy Has Right To Be Heard on Any Issue

On June 6, 2024, the United States Supreme Court, in Truck Insurance Exchange v. Kaiser Gypsum Co., Inc., No. 22-1079, unanimously held that an insurer with financial responsibility for bankruptcy claims is a “party in interest” in a Chapter 11 bankruptcy. The Court held the “insurance neutrality doctrine” applied by the courts below was too limited to determine insurer standing. While “insurance neutrality” – preserving insurer rights and defenses under insurance contracts – is important, the doctrine overlooks the myriad ways bankruptcy proceedings and reorganization plans can alter and impair insurer interests.
