I'm so excited to publish my article exploring Tennessee's ELVIS Act that was just passed. AI law is such an exciting field to me, and I'm having a lot of fun following all of the new developments. The laws we are drafting now will shape the landscape of AI for years to come, so it's really important to be thoughtful and critical about how we approach AI regulation.

As a developer I find generative AI facilitating. It allows us to quickly iterate ideas and concepts and lets us break past barriers in our perception. But the way in which every day people are exploited by corporations using these tools for profit is unjust and unfair. Laws and regulations must be passed and we must stand together to properly compensate not just artists but all the industries in which this technology effects. It is up to us as developers to conduct safe and just practice. To question the way we do things in the way we generate and procure data. This is not just an issue that will live and die with the arts, this is something that will change most if not all industries in some way or form. If we let corporations continue the path their on, there will be no place for any of us in whatever industry we come from. Don’t let yourself be fooled, you are replaceable and there is a process in ML that can and will replace you, if not today, tomorrow. It’s not all doom and gloom, as with all new technology we must understand how we change the world. How we safeguard people’s livelihood and how we can use it to benefit us all. This is a pivotal point in humanity for us to rewrite the rules. Don’t stand by the wayside and let inaction get the best of us. Speak up, talk with the people you work with. There are times to be silent and there are times for action. Now is the time for action.
Karla Ortiz spoke on Capital Hill exposing the ugly Truth behind Generative Ai companies such as Stable Diffusion, Midjourney and Adobe, who were all present. Karla revealed cold facts such as artist, Greg Rutkowski, behing scraped over 400,000 times without his consent. Beside her and also revealing the truth of GenAi are legal representatives from Universal Music.
Great contribution from Karla Ortiz to the Generative AI discussion on how many of the most popular GenAI models are training datasets without artist "consent, credit or compensation".
At Tafi and Daz 3D, we are very different. We believe in the power of GenAI but are taking a 'creator-first' approach. All artists will 'opt-in' for their content (and derivatives) to be used, and contributors will be compensated accordingly.
As industry insiders say, a sound GenAI strategy starts with a data strategy. Read more at maketafi.com/ai and feel free to sign-up for the beta so we can get your feedback!

Glad to see artists speaking out against this kind of technology. This isn’t about a new tool and resisting advancement in software. This is about a technology that is actively working against we creatives. It attempts to steal human creativity and replace artists at a fraction of the cost. We live in a time where content is churned out at light speed and devoured by a binge-mode culture. This kind of technology only further feeds into that problem. It doesn’t seek to address it.
After all, isn’t the whole point of story telling to reflect the human experience? Why are we replacing us with tech? If it’s all for the sake of speed (and lining someone elses pockets)…well, isn’t that something worth fighting against?

And don’t give me ‘Generative AI will augment creativity and create millions of jobs’ - because we both know it’s naivety at best (because humans will never misuse tech for profit?), most likely it’s a cynical misdirection (under the delusion that YOU won’t get affected) or a complete disregard to the value of anyone’s input or gain but your own's (because you will know you can have direct value from it on the expense of others).

Hm, I disagree that it is unlike anything we've seen before, it is just another way in which technology changes the course of an economy.
When you really think about it - it is the same story all over again (just think GDPR from 1995 to 2018 to today), and it is: taking someone's data without their consent to create or improve commercial outcomes.
I remember the first wave of targeted, well, EVERYTHING using customer data without their consent (it took a while to even accept that this "consent" thing is a thing), and only then realizing that maybe that wasn't the fairest thing to do. Nowadays, we wouldn't dream (well, most of us...) use personal data without consent to train commercial models, and the same could be true for using proprietary data for training generative AI models in this context.
That said, if something comes along that can do your job better than you and benefits an array of stakeholders in the pipeline, but needs you to do the job well/generate value, then absolutely you need to charge them for that service (of making them better and helping them have something to offer). Your direct audience might change, and you might have to rethink your place in the supply chain, but the fact remains that that training data would not have existed if it weren't for these artists, and that deserves at least some consideration.
What do you think?

Poignant and insightful commentary by the incredibly talented Karla Ortiz. thank you Karla for fighting for artists rights.
I am generally an AI optimist, truly believing AI tools can bring huge positive change for artists and society as a whole...but only if used responsibly and respectfully, at the very least legally! How the current law suits against AI providers such as Midjourney, shake out depends on whether the practice of using copyrighted materials for training AI is considered fair use. I personally dont think it can be. These tools are for profit and the fact they can producce essentially infinite image simultaneous and many times faster than any human can hope to means they are, as Karla rightly points out, like no technology that has come before.
It is up to us now to decide how the future of this technology and our society is shaped. if you have an opinion make it known.

This is a pressing issue. We cannot hide behind the guise of progress. AI tools are based on human intellectual property, hard earned. Ignoring this will continue a broken relationship between human intellect and Artificial Intelligence that companies will continue to exploit. We need to credit human beings. By all means, use AI, it's a great tool. Just know where it comes from, and demand a sustainable and fair relationship for society's sake. AI did not just suddenly appear.
