I think that both of Lawrence Lessig’s takes here are fundamentally correct. To paraphrase: 1. The act of learning something from a copyrighted example, whether human or machine, isn’t a copyright event. a. You might want some other regulatory means of handling such matters. 2. The U.S. Copyright Office is conducting a study regarding the copyright issues raised by generative artificial intelligence (AI). This study will collect factual information and policy views relevant to copyright law and policy. The Office will use this information to analyze the current state of the law, identify unresolved issues, and evaluate potential areas for congressional action. The Office published a notice of inquiry on August 30, 2023. Initial written comments are due by 11:59 p.m. eastern time on October 30, 2023. Reply comments are due by 11:59 p.m. eastern time on November 29, 2023.
