Copyright Office is holding a webinar regarding registration of #ai generated works on June 28. Definitely worth attending if you or clients have questions about the CO’s take on authorship and registerability. I’m personally curious about what, if any, special training personnel will receive (or if experts will be hired) to evaluate applications with AI components or to discern whether deposit material contains AI content when the application doesn’t disclose it (cuz that’s definitely going to happen). Did the SCOTUS write a death sentence for Generative AI modules such as Dall-E and Midjourney? Very recently, the Supreme Court of The United States in the case of Andy Warhol Foundation v. Goldsmith, held that "Transformative Use" will no longer be the primary factor while determining whether a reproduced piece of work infringes the copyright of the original author. Instead, the deciding factor is now going to be the PURPOSE for which the second piece of work has been created. Under the old view, content generated by AI in most scenarios could have been granted the benefit of the Fair Use Doctrine as observed in cases such as Authors Guild v. Google where AI using the original work to create something new was held to be fair use. Since most of the Generative AI modules are paid subscriptions, the Courts could have the opinion that the commercial nature of the service makes it likely to financially compete which is the purpose of the original work, and it would not matter whether the reproduced work is transformative or not. Only time will tell how this is going to be resolved since a class action suit against many AI companies such as deviantart and midjourney has already been filed in the US. #ipr #iprights #copyright #fairuse #technologylaw
