Very honoured that I could attend the 79th session of UNCITRAL Working Group II (Dispute Settlement) in New York in the week of 12-16 February 2024 as delegate of FICA (Forum for International Conciliation and Arbitration) and that we were able to participate with the other delegations in the discussion on UNCITRAL clauses for technology-related dispute resolution and adjudication on which the Working Group reached consensus. #arbitration #internationalarbitration #internationallaw  #uncitral #disputeresolution  #disputesettlement

The Terms of Reference is a key feature of ICC arbitration. It sets out the names and addresses of the parties and their representatives, a summary of their claims, the place of arbitration, and, if appropriate, a list of the issues to be determined by the tribunal. These are usually reviewed in draft form by the parties at the request of the tribunal, after which it must be signed by both the parties and the arbitrators and submitted to the ICC. #wat #ciarb #ciarbghanachapter #disputeresolution

In a ground breaking decision, the U.S. District Court for the Eastern District of Louisiana recently declined to enforce an arbitration agreement in which the parties had agreed to resolve their dispute under the now defunct DIFC-LCIA Arbitration Rules. The court held that Dubai Decree 34 of 2021 rendered the DIFC-LCIA Arbitration Centre non-existent, deeming the arbitration clause invalid.
