BREAKING NEWS! The government's response to the consultation on reforms to retained EU employment law is out today! And most of it is good news for #employers and #RecruitmentBusinesses as the proposed reforms offer some streamlining and efficiency gains. Working time and record keeping - There has been some uncertainty over employers' record keeping requirements under the Working Time Regulations (WTR) as a result of a European decision which stated that employers must have an objective, reliable and accessible system enabling the duration of time worked each day by each worker to be measured will be removed. The government is restoring the status quo so employers will only have to keep "adequate records". Holiday - Unfortunately plans to create "one pot of annual leave entitlement" of 5.6 weeks have been abandoned. The government will maintain the existing two "pots" of annual leave so that workers continue to receive 4 weeks at the normal rate of pay and 1.6 weeks at the basic rate of pay. But, the government will legislate to clarify what "normal remuneration" is for the purposes of calculating the leave. Hopefully this will remove some of the current complications around variable pay like overtime and commission. It will also introduce rolled-up holiday pay which will be paid at 12.07% of hours worked. This entitlement will be for irregular hours workers and part-year workers which will also include some agency workers. The government will define in legislation what it means by irregular and part-year workers. TUPE - Finally, the government has confirmed that it will be introducing its proposed TUPE reforms. Small businesses, with fewer than 50 employees, undertaking a transfer of any size, and businesses of any size undertaking a small transfer (of fewer than 10 employees) will be able to consult with employees directly if there are no existing trade union or worker reps in place. Unemployment dipped, so has hiring, while the job market has gotten much more competitive. This makes it even more challenging for age 40+ job seekers. My article (https://lnkd.in/g9wFy7z3) describes how age 40, 50, and 60+ job seekers can do more to beat employment ageism than just get angry. It's a strange combination of competing trends in September 2023's job market: Hiring down 23.8% from a year ago, declining in nearly every industry and major metro (LinkedIn's September Workforce report). Candidate competition increases: Job seekers apply for 25% more jobs (LinkedIn's Chief Economist @Karin Kimbrough's comments on @Andrew Seaman's podcast yesterday). Intersecting with these trends are unemployment numbers that dipped this week, after a summer of increasing jobless claims. It's realistic to believe you can still find a great job, despite hiring slowdowns and increased competition. But a successful Age 40+ job search in 2023 requires very different resume/interview/job search strategies than what worked in the opposite job environment that existed last year. A tougher job market with more competition requires different strategies for age 40. 50. and 60+ job seekers to win your 2023 search.

The Government has announced its acceptance of the Low Pay Commission’s recommendations on minimum wage rates to apply from April 2024. The National Living Wage is extended to 21 and 22 year olds and this will also be the largest ever increase in the minimum wage ,in cash terms, and the first time it has increased by more than £1.
