Legal Momentum, the Women's Legal Defense and Education Fund, celebrates the updated guidance on workplace harassment that the EEOC issued on April 29, 2024. No one should experience harassment based on sex or other protected characteristics, or be made to feel unsafe, at work. The guidance recognizes that prohibited sex harassment encompasses harassment based on pregnancy, childbirth, and related medical conditions—including abortion—as well sexual orientation and gender identity. Positively, the guidance includes examples illustrating the myriad ways that workplace sex harassment can manifest. We were especially glad to see that the EEOC made changes to the final guidance in line with comments Legal Momentum and our partners (Futures Without Violence & Legal Aid at Work) submitted emphasizing how sex harassment includes the harassment of victims of domestic violence and other forms of gender-based violence. As the guidance acknowledges and illustrates, sex-based harassment includes harassment based on stereotypes about victims of gender-based violence, who are often pushed out of the workplace at the time when they most need to work. About filing an Employment Discrimination charge with EEOC: Ø If you want to sue someone for discrimination based on race, color, religion, sex (including pregnancy, gender identity, and sexual orientation), national origin, age (40 or older), disability, genetic information, or retaliation, you need to first file a charge with the EEOC (except for lawsuits under the Equal Pay Act). Ø Once the EEOC investigation is closed, they will provide you with a Notice of Right to Sue. This notice grants you permission to file a lawsuit in federal or state court.
