American Bankruptcy Institute Journal
The article focuses on ramifications of the Supreme Court’s Stern v. Marshall case, which held that a bankruptcy court does not have the constitutional power to enter final judgments on counterclaims against a creditor that arise under state law. Decisions in trial and appellate courts have varied as to whether a party can waive its rights under Stern v. Marshall, and the Supreme Court will review the issue in its upcoming term when it hears the appeal for In re Bellingham Insurance Agency.
