Big Changes to Maine’s Reporting Requirements and PFAS Phase-Out In April, Maine’s Governor Mills signed a new law (Public Law c. 630) that significantly changes the per- and polyfluoroalkyl substances (PFAS) reporting requirements and phase-out program, effective August 9, 2024. This law eliminates the broad notification requirement and introduces a new, focused reporting program. Key product categories are now exempt from sales bans, allowing manufacturers to innovate and reformulate their products. The staged timeline for sales prohibitions extends through 2040, ensuring manufacturers have time to adapt. EPA’s New PFAS TRI Reporting Requirements ✍ Manufacturing facilities subject to reporting under the Toxics Release Inventory (TRI) are urged to take notice. EPA finalized the addition of certain per-and polyfluoroalkyl substances (PFAS) to TRI, starting with the 2024 reporting year. This action requires facilities to report chemical releases to the environment, transfer to waste management facilities, and other significant handling of the following PFAS: • Perfluorohexanoic acid (PFHxA) (CAS RN 307-24-4) • Perfluoropropanoic acid (PFPrA) (CAS RN 422-64-0) • Sodium perfluorohexanoate (PFHxA-Na) (CAS RN 2923-26-4) • Ammonium perfluorohexanoate (PFHxA-NH4) (CAS RN 21615-47-4) • 1,1,1-Tf-N-[(trifluoromethyl)sulfonyl] methanesulfonamide (TFSI) (CAS RN 82113-65-3) • Lithium bis[(trifluoromethyl)sulfonyl] azanide (CAS RN 90076-65-6) • Betaines, dimethyl(.gamma.-.omega.-perfluoro-.gamma.-hydro-C8-18-alkyl) (CAS RN 2816091-53-7) This update marks the latest development in the rapidly evolving PFAS regulatory landscape. Currently, PFAS or classes of PFAS are automatically added to the TRI list following certain other regulatory actions, such as the finalization of a new toxicity value, the issuance of a significant new use rule (SNUR), addition to an existing SNUR, or designation as an active chemical substance under the Toxic Substances Control Act (TSCA) Section 8(b). Final toxicity values for 6 PFAS were published in 2023. As more PFAS are subject to these regulatory actions, more PFAS will be added to the TRI list. Industries that may be affected by this regulatory update include food and beverage manufacturers, fabric and textile milling, leather tanning, sawmills, pulp mills, and many more. The final rule is effective June 17, 2024.
