The Treasury Department and IRS have released new guidance on the registration requirements for the 45Z Clean Fuel Production tax credit. Key points include: Registration Requirement: Taxpayers must have a signed registration letter from the IRS to claim the 45Z credit for transportation fuel production starting January 1, 2025. Without this letter, no credit can be claimed for fuel produced and sold before the date on the letter. Application Deadline: To ensure timely processing, completed registration applications should be submitted by July 15, 2024. Applications received by this date are expected to be processed by January 1, 2025. Late applications may not be processed in time for the start of the credit period. Form 637: Applicants must use Form 637, indicating Activity Letter “CN” for non-SAF transportation fuel producers, “CA” for SAF producers, or both. Until the revised form is available, current forms can be used with these notations. Action Required: Taxpayers planning to claim the 45Z credit are encouraged to apply for registration promptly to ensure compliance and eligibility. For more details, refer to Appendix A for eligible feedstocks and further procedural information.

The Qualifying Advanced Energy Project Credit (§ 48C) program aims to strengthen U.S. industrial competitiveness and clean energy supply chains. Projects that aim to reduce ghg emissions may qualify for 30% tax credit of the cost basis. Treasury, IRS, and DOE have opened applicants to register for a new round of allocations.
