1. SCOPE AND UPDATES TO THIS PRIVACY NOTICE


This Privacy Notice applies to personal information processed by us, including on our website (www.fakespot.com), our software applications (browser extensions and mobile applications), Trusted Deals, and other online or offline offerings (collectively, the "Service" or "Services").


Changes to our Privacy Notice. We may revise this Privacy Notice from time to time in our sole discretion. If there are any material changes to this Privacy Notice, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Notice if you continue to use our Services after the new Privacy Notice takes effect.

All personal information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live.


If we transfer personal information which originates in the European Economic Area, Switzerland, and/or the United Kingdom to a country that has not been found to provide an adequate level of protection under applicable data protection laws, one of the safeguards we may use to support such transfer is the EU Standard Contractual Clauses.

We store the personal information we collect as described in this Privacy Notice for as long as you use our Services, or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

We “sell” and “share” your personal information to provide you with “cross-context behavioral advertising” about Fakespot’s products and services.


Additional Disclosures for California Residents


Opting Out of “Sales” of Personal Information and/or “Sharing” for Cross-Context Behavioral Advertising under the CCPA. California residents have the right to opt out of the “sale” of personal information and the “sharing” of personal information for “cross-context behavioral advertising.” California residents may exercise these rights by contacting Fakespot at [email protected].


Disclosure Regarding Individuals Under the Age of 16. Fakespot does not have actual knowledge of any “sale” of personal information of minors under 16 years of age. Fakespot does not have actual knowledge of any “sharing” of personal information of minors under 16 years of age for “cross-context behavioral advertising.”


Disclosure Regarding Sensitive Personal Information. Fakespot only uses and discloses sensitive personal information for the following purposes:


Non-Discrimination. California residents have the right not to receive discriminatory treatment by us for the exercise of their rights conferred by the CCPA.


Verification. To protect your privacy, we will take steps to reasonably verify your identity before fulfilling requests submitted under the CCPA. These steps may involve asking you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. Examples of our verification process may include following up with you to confirm that you are a user of the Services.


Authorized Agent. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. To authorize an agent, provide written authorization signed by you and your designated agent using the information found in “Contact Us” below and ask us for additional instructions.


10. SUPPLEMENTAL NOTICE FOR NEVADA RESIDENTS


If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. You can exercise this right by contacting us at [email protected] with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your personal information as sales are defined in Nevada Revised Statutes Chapter 603A. 11. CHILDREN’S INFORMATION


You must be at least 13 years old (or other age as required by local law outside the United States) to use the Service. The Service complies with the rules of the Children’s Online Privacy Protect Act (“COPPA”). COPPA applies to the online collection of personal information from children under 13. Accordingly, the Service does not permit anyone under the age of 13 to use the Service. In addition, the Service does not knowingly collect or solicit any information from anyone under the age of 13. If the Service unknowingly collects personal information from a child under the age of 13 without parental consent, we will delete that information as soon as possible. Third-Party Websites/Applications. The Services may contain links to other websites/applications and other websites/applications may reference or link to our Services. These third-party services are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen, or approve, and are not responsible for, the privacy practices or content of such other websites or applications. Providing personal information to third-party websites or applications is at your own risk.


Marketing Affiliates. Fakespot partners with third-party businesses through affiliate marketing programs (collectively “Marketing Affiliates”) to offer you product and seller alternatives through our Services. As a result, Fakespot may earn commission from its Marketing Affiliates from some of your interactions with our Services including, but not limited to, clicking on links to third-party websites, clicking on advertising links, or purchasing an item. Fakespot does not share or sell any of your personal information generated on our Services to our Marketing Affiliates.
