On February 8, 2024, the Federal Communications Commission announced a unanimous adoption of a Declaratory Ruling that recognizes calls made with AI-generated voices are “artificial” under the Telephone Communications Protection Act (TCPA).

Under the TCPA, it is unlawful for an organization to make a call without the prior express consent of an individual through the use of an automatic telephone dialing system or an artificial or prerecorded voice.

Bad actors have been increasingly using AI generated voices in unsolicited robocalls to extort vulnerable family members, imitate celebrities, and misinform voters. The FCC action is working to target the outcome of unwanted AI-voice generated robocalls, making the act of using AI to generate the voice in theses robocalls itself illegal.
