The Maya of Bitcoin

Banking regulators worldwide loathe crypto-currencies because they could undermine their position as the sole issuer of sovereign currencies. Thus, Bitcoins/crypto-currencies in India will likely be defined as an 'asset'. But that would be playing with fire. First, Bitcoin was always intended to be a currency. Second, they are already integrated into the formal system as a mode of payment and are being freely used as currencies. Hence, they ought to be defined as currencies and treated like one-with adequate restrictions. After all, the RBI is mulling its own blockchain-based currency 'Lakshmi'. "The need of the hour is to introduce the law in the shortest possible timeframe with the implementation of artificial intelligence and machine learning algorithms," says Prity Khastgir, CEO at Tech Corp International Strategist. -

It is a noteworthy fact that India has 26 recognized endemic centers that are home to nearly a third of all the flowering plants identified and described to date. The Biodiversity Act defines biological diversity as the variability among living organisms from all sources and the ecological complexes of which they are part, and includes diversity within species or between species and of ecosystems. Therefore, it is very important to safeguard India's biodiversity and with this view the biological diversity act, 2002 plays an important role. According to section 3, all foreign nationals require prior approval from NBA for obtaining biological resources. It is important to safeguard the biological resources from being misused by any entity. The current timeline to dispose the application is six months from the date of its receipts. That is hampering the innovation in biotech by delaying the approval process from the date of receipt of application. In my view, the timeline should not be more than two months to grant the approval as the long time period would refrain foreign nationals from investing their resources in India. Subsequently, a balance of convenience has to be maintained in safeguarding the biological resources and at the same time respecting the research and development activities of scientific institutions. Any person desirous of transferring results of research relating to biological resources obtained from India for monetary consideration to foreign nationals, companies and Non Resident Indians (NRIs), should definitely seek approval for transferring results of research in the national interest of the country.

Article titled "Indo-China Case Study on Regulatory Challenges" page no. 18
Technological innovation is essential to the future well being of every nation. The ability of a nation to sustain economic growth, increase its standard of living, and improve human health and surrounding environment, directly depends upon the successful development and commercialization of new products, processes and services.
Generally, the terms invention, innovation and commercialization are applied in a number of overlapping ways to the process of developing new technology and incorporating it into new products, processes and services. However, confusion often results from the close ties between these three terms, and hence a clear definition of these terms becomes necessary to understand their dynamics and their intersection with each other.
Invention refers to the act of devising or fabricating a novel process, product, or service, including initial conception, but not the act of putting it to use. Inventions are protected by patents, which may be licensed or assigned, and may further be commercialized.
On the other hand, innovation refers to the application and development of the novel process, product, or service, and includes, technical, scientific and market research; and marketing and manufacturing to the extent that it supports the application of the novel process, product, or service, whereas commercialization refers to the efforts to make profits from the sale or use of the novel process, product, or service. -

With regards to the enforceability of patents in India, it is crucial to note that since the advent of a pharmaceutical patent regime in 2005, the number of patent litigations in India has witnessed a rapid increment. However, courts have yet not received a level wherein the correct standards for the grant (or non grant) of an injunction or a restraining order may be determined.
This article will provide a basic overview regarding local working requirements of granted patents in India in light of recent developments, and a brief analysis of enforceability of patents in India.
Key topics covered in the article are:
* Development of Intellectual Property Regime
* Local working of patents: Indian Perspective
* Compulsory Licensing and Revocation of Patents in India
* Revocation of Patent
* Enforceability of Patents: Indian Scenario

In the past few decades, globalization phenomenon has received considerable attention and has fashioned both the discourse and the behavior of academics, policymakers and managers. One symptom of a globalizing world is the surfacing of entrepreneurial start-ups that have an international outlook from inception.
However, before early-stage entrepreneurs can go to market, they must literally prove to themselves with their innovations, which may involve developing a research technology further, perhaps to a working prototype, and/or studying the markets to see if the business concept will create an economic impact.
While start-up firms create a substantial economic impact on most economies, the failure rate of start-up firms seems to remain high over time. There is an ever growing influence of intellectual capital management on business performance, which generally includes the human capital of the entrepreneur, organizational capital, and relational capital are important intangible assets, which seem to be related positively to venture performance.
