    It is a noteworthy fact that India has 26 recognized endemic centers that are home to nearly a third of all the flowering plants identified and described to date. The Biodiversity Act defines biological diversity as the variability among living organisms from all sources and the ecological complexes of which they are part, and includes diversity within species or between species and of ecosystems. Therefore, it is very important to safeguard India's biodiversity and with this view the biological diversity act, 2002 plays an important role. According to section 3, all foreign nationals require prior approval from NBA for obtaining biological resources. It is important to safeguard the biological resources from being misused by any entity. The current timeline to dispose the application is six months from the date of its receipts. That is hampering the innovation in biotech by delaying the approval process from the date of receipt of application. In my view, the timeline should not be more than two months to grant the approval as the long time period would refrain foreign nationals from investing their resources in India. Subsequently, a balance of convenience has to be maintained in safeguarding the biological resources and at the same time respecting the research and development activities of scientific institutions. Any person desirous of transferring results of research relating to biological resources obtained from India for monetary consideration to foreign nationals, companies and Non Resident Indians (NRIs), should definitely seek approval for transferring results of research in the national interest of the country.

    Technological innovation is essential to the future well being of every nation. The ability of a nation to sustain economic growth, increase its standard of living, and improve human health and surrounding environment, directly depends upon the successful development and commercialization of new products, processes and services.

    Generally, the terms invention, innovation and commercialization are applied in a number of overlapping ways to the process of developing new technology and incorporating it into new products, processes and services. However, confusion often results from the close ties between these three terms, and hence a clear definition of these terms becomes necessary to understand their dynamics and their intersection with each other.

    Invention refers to the act of devising or fabricating a novel process, product, or service, including initial conception, but not the act of putting it to use. Inventions are protected by patents, which may be licensed or assigned, and may further be commercialized.

    On the other hand, innovation refers to the application and development of the novel process, product, or service, and includes, technical, scientific and market research; and marketing and manufacturing to the extent that it supports the application of the novel process, product, or service, whereas commercialization refers to the efforts to make profits from the sale or use of the novel process, product, or service.

    The World Intellectual Property Organization (WIPO), in cooperation with India's Council of Scientific and Industrial Research (CSIR), is organizing an International Conference on the Utilization of the Traditional Knowledge Digital Library (TKDL) as a Model for Protection of Traditional Knowledge, in New Delhi, India, from March 22 to 24, 2011. Participants from India and some 35 other countries are expected to attend the meeting. All WIPO Member States, and in particular patent offices that have TKDL Access and Non-disclosure Agreements with the CSIR have been invited.
    Objectives

    The Conference aims to:

    * share experiences and information on the role of a TKDL in the documentation of traditional knowledge (TK);
    * identify the intellectual property (IP) issues in and technical implications of the establishment of a TKDL; and
    * explore the role and functioning of the TKDL within the international IP protection system.
