Microsoft Feedback - Preview Terms

IF YOU LIVE IN (OR YOUR PRINCIPAL PLACE OF BUSINESS IS IN) THE UNITED STATES, PLEASE READ THE BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER. IT AFFECTS HOW DISPUTES ARE RESOLVED.

Microsoft Feedback is a preview. Feedback may not operate correctly and may be different from the commercially released version.

Description of the Service

Feedback is a new Microsoft service that allows customers to participate in community feedback and provide feedback to Microsoft Customers can see the status of feedback they've provided and any official responses from Microsoft about their feedback Feedback is built on Dynamics 365 Customer Service.

Acceptance of Terms

Before using the Microsoft Feedback, please carefully review all the Terms which create a legal agreement between you and Microsoft Corporation (or, based on where you live, or if a business, where your principal place of business is located, one of its affiliates) and governs your use of Microsoft Feedback, once accepted by you, applies to you.

By registering for and using Microsoft Feedback, you agree to the Microsoft Privacy Statement and all Terms.

By using Microsoft Feedback, you represent you are the legal age of "majority" where you live and agree to be bound by the terms of this Agreement.

Feedback submissions

If you submit feedback (Submissions) you give to Microsoft, without charge, the right to use, share and commercialize your feedback in any way and for any purpose.  You will not give feedback that is subject to a license that requires Microsoft to license its software or documentation to third parties because Microsoft includes your feedback in them. These rights survive this agreement.

No compensation will be paid with respect to the use of your Submission, as provided herein. Microsoft is under no obligation to post or use any Submission you may provide, and Microsoft may remove any Submission at any time in its sole discretion.

By posting a Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in these Terms of Use including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

In addition to the warranty and representation set forth above, by Posting a Submission that contain images, photographs, pictures or that are otherwise graphical in whole or in part ("Images"), you warrant and represent that (a) you are the copyright owner of such Images, or that the copyright owner of such Images has granted you permission to use such Images or any content and/or images contained in such Images consistent with the manner and purpose of your use and as otherwise permitted by these Terms of Use and the Services, (b) you have the rights necessary to grant the licenses and sublicenses described in these Terms of Use, and (c) that each person depicted in such Images, if any, has provided consent to the use of the Images as set forth in these Terms of Use, including, by way of example, and not as a limitation, the distribution, public display and reproduction of such Images. By Posting Images, you are granting (a) to all members of your private community (for each such Images available to members of such private community), and/or (b) to the general public (for each such Images available anywhere on the Services, other than a private community), permission to use your Images in connection with the use, as permitted by these Terms of Use, of any of the Services, (including, by way of example, and not as a limitation, making prints and gift items which include such Images), and including, without limitation, a non-exclusive, world-wide, royalty-free license to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Images without having your name attached to such Images, and the right to sublicense such rights to any supplier of the Services. The licenses granted in the preceding sentences for Images will terminate at the time you completely remove such Images from the Services, provided that, such termination shall not affect any licenses granted in connection with such Images prior to the time you completely remove such Images. No compensation will be paid with respect to the use of your images.

Privacy and Protection of Personal Information

Your privacy is important to us. Please read the Microsoft Privacy Statement (the "Privacy Statement") as it describes the types of data we collect from you and your devices, how we use that data, and the legal bases we have to process that data. Where processing is based on consent and to the extent permitted by law, by agreeing to these Terms, you consent to Microsoft’s collection, use and disclosure of Your Content and data as described in the Privacy Statement. In some cases, we will provide separate notice and request your consent as referenced in the Privacy Statement.

Public user information and Content: The user information you provide (including your My Profile name, avatar image, and any content you may post) will be publicly viewable viewed by other users. Microsoft may also collect and publicly display the date that you registered and your affiliation with Microsoft. You may be able to delete certain types of Content after they have been posted.

Code of Conduct

The following Code of Conduct applies to your use of the Feedback and any associated services. Microsoft reserves the right to update the Code of Conduct at anytime, without notice to you. The most current version of the Code of Conduct can be viewed at Microsoft Feedback Code of Conduct.

In addition to upholding this Code of Conduct, you're also responsible for adhering to all applicable local and national laws. This is your community. Help us to keep it safe, friendly, fun, and helpful.

Do

  • Be polite and respectful in your posts, and in your replies to other people.

  • Keep conversation threads on track and constructive. It's okay to disagree with another user's post, but don't take the thread off track to do so. Always address your comments to the person who asked the initial question, not the other posters.

  • Cite the source of anything you post or upload if it isn't your own original content. Be honest about your sources.

  • Keep it clean. No profanity, obscenity, insulting or bigoted comments or feedback please.

  • If providing feedback in community experiences, search to see if the feedback you’d like to give has already been posted. You can then comment on that feedback or vote on it.

  • Report any kind of abuse you find in the community. you'll find "Report abuse" links in every post and in every profile.

Don't

  • Post feedback that is the same or similar to feedback you have already posted.

  • Threaten, stalk, insult, victimize or intimidate anyone (or group of people) for any reason, including on the basis of age, gender, disability, ethnicity, sexual orientation, race, or religion.

  • Incite other users to threaten, stalk, insult, victimize, or intimidate another person or group of people.

  • Harass, insult, tease, or correct other users about the grammar used in their posts. Good or bad grammar isn't the point-the feedback community is about sharing feedback with Microsoft and others within the community.

  • Post content showing nudity of any sort, including full or partial photographic human nudity, or nudity in cartoons, fantasy art, or manga.

  • Post chain letters.

  • Link to websites that require payment to access information.

  • Post links to external sites that violate this Code of Conduct.

Things that will get you immediately banned from participating in feedback

  • Posting content that is intended to harm or exploit minors in any way, including collecting the personally identifiable information (PII) of any minor (anyone under18 years old), including, but not limited to: name, email address, home address, phone number, or the name of the minor's school.

  • Invading anyone's privacy by attempting to harvest, collect, store, or publish private or personally identifiable information, such as passwords, account information, credit card numbers, addresses, or other contact information without that person's knowledge and willing consent.

  • Posting content or links to content that is illegal or violates any applicable local or national laws.

  • Posting or spreading viruses, worms, malware, or other software intended to harm another user's computer.

  • Impersonating a Microsoft employee, agent, manager, host, administrator, moderator, another user, MVP, or any other person through any means.

  • Pirating Microsoft software or products, or offering pirated software or products for sale, including posting product keys.

  • Specifically violating Microsoft licensing or terms, such as posting content or links that will install a 3rd party kernel, or evade security measures built into the software.

  • Promoting or otherwise facilitating the purchase and sale of ammunition or firearms.

  • Posting 'spam,' 'pyramid schemes,' 'affiliate marketing,' or unsolicited commercial advertisements of any kind, including advertising for money making schemes, discount cards, credit counseling, online surveys, or online contests.

  • Attempting to manipulate the forums, or other community features, including ranking and reputation systems, by violating any of the provisions of this Code of Conduct, colluding with others on voting, or using multiple profiles.

  • Offering to make international money transfers for amounts exceeding the asking price of an item, with intent to request a refund of any portion of the payment.

  • Using any form of automated device or computer program that enables the submission of postings without the express written consent of Microsoft Corporation.

Community User Cautions

  • Be very cautious about accepting direct help from another user. If that user suggests they can use Remote Assistance to help you, be aware that that user will have access to your computer, and that your computer could be hacked.

  • If you volunteer to help another user through Remote Access, be careful not to harm their computer in any way, or to access information that isn't openly made available to you. Abuse of Remote Access will not be tolerated and will result in your being banned from the community.

  • Be careful with your personal information. If you provide your email address in a post when providing feedback publicly, it may be used for any purpose by the general public.

  • Don't post information that could be used by others to steal your identity, like your street address, your phone number, your social security number, or your credit card number.

Termination and Cancellation

Microsoft reserves the right, at its sole discretion and without any obligation to do so, to review and remove user-created services and content at will and without notice and delete content and accounts. Microsoft reserves the right, at its sole discretion, to permanently ban participants or terminate access to the feedback community. Microsoft further reserves the right to decommission its feedback experiences at any time in the future.

Rights and Responsibilities

  • We encourage you to not share information that others could use to harm you. We encourage parents to be aware of and help exercise control over content posted by and activities of their children to keep them safe online.

  • Microsoft isn't responsible for the content of any user-created posting, listing, or message. The decision to view content or engage with others is yours. We advise you to use your judgment.

  • You are responsible for protecting your computer against interference, spyware, or viruses that may be encountered. We recommend you install a virus protection program on your computer and keep it up to date.

  • You may use the Report Abuse links in the public feedback communities to report violations of this Code of Conduct.

  • Microsoft reserves the right to amend or change the Code of Conduct or any service at any time without notice. We encourage you to periodically review these guidelines to ensure you are in compliance.

  • Some information you provide or upload to the service may be stored outside of the country in which you reside.

  • All activity on the service is also governed by the Microsoft Terms of Use and the Microsoft Privacy Policy.

  • You acknowledge that by providing feedback to Microsoft privately or within a public feedback community you are a volunteer participant in the feedback community and that you may discontinue your participation at any time. Nothing related to your participation will be construed as creating an employer-employee relationship, a partnership, joint venture, association, or agency relationship, or as a limitation upon Microsoft's right to terminate your access as foreseen above, or upon Microsoft's discretion, to terminate your access as provided herein. You assume all risk for your use.

  • You understand that posting content or submitting material is voluntary, and you are under no obligation whatsoever to provide any submissions or contributions. You are solely responsible for your dealings with any third party that relates to your use of the community, or any information or materials you obtain from a third party.

  • No Compensation. Microsoft shall not be obligated to provide, and you have no expectation of receiving, any compensation in any form for your voluntary participation in the community, or for your submissions or contributions.

Unsolicited Idea Submission Policy, Reservation of Rights and Supplemental Feedback

MICROSOFT OR ANY OF ITS EMPLOYEES DO NOT ACCEPT OR CONSIDER UNSOLICITED IDEAS, INCLUDING IDEAS FOR NEW ADVERTISING CAMPAIGNS, NEW PROMOTIONS, NEW PRODUCTS OR TECHNOLOGIES, PROCESSES, MATERIALS, MARKETING PLANS OR NEW PRODUCT NAMES. PLEASE DO NOT SEND ANY ORIGINAL CREATIVE ARTWORK, SAMPLES, DEMOS, OR OTHER WORKS. THE SOLE PURPOSE OF THIS POLICY IS TO AVOID POTENTIAL MISUNDERSTANDINGS OR DISPUTES WHEN MICROSOFT'S PRODUCTS OR MARKETING STRATEGIES MIGHT SEEM SIMILAR TO IDEAS SUBMITTED TO MICROSOFT. SO, PLEASE DO NOT SEND YOUR UNSOLICITED IDEAS TO MICROSOFT OR ANYONE AT MICROSOFT. IF, DESPITE OUR REQUEST THAT YOU NOT SEND US YOUR IDEAS AND MATERIALS, YOU STILL SEND THEM, PLEASE UNDERSTAND THAT MICROSOFT MAKES NO ASSURANCES THAT YOUR IDEAS AND MATERIALS WILL BE TREATED AS CONFIDENTIAL OR PROPRIETARY.

Except as expressly provided under these Terms, Microsoft does not grant you a license or any other rights of any type under any patents, know-how, copyrights, trade secrets, trademarks or other intellectual property owned or controlled by Microsoft or any related entity, including but not limited to any name, trade dress, logo or equivalents. If you give to Microsoft any idea, proposal, suggestion or feedback, including without limitation ideas for the Services, new products, technologies, promotions, product names, product feedback and product improvements ("Supplemental Feedback"), you give to Microsoft, without charge, royalties or other obligation to you, the right to make, have made, create derivative works, use, share and commercialize your Feedback in any way and for any purpose. You will not give Feedback that is subject to a license that requires Microsoft to license its software, technologies or documentation to any third party because Microsoft includes your Feedback in them.

No Unlawful or Prohibited Use

As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any Microsoft server, or the network(s) connected to any Microsoft server, or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any Microsoft server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.

Pursuant to Title 17, United States Code, Section 512(c)(2), notifications of claimed copyright infringement should be sent to Service Provider's Designated Agent. ALL INQUIRIES NOT RELEVANT TO THE FOLLOWING PROCEDURE WILL NOT RECEIVE A RESPONSE. Explore the Notice and Procedure for Making Claims of Copyright Infringement.

Binding Arbitration and Class Action Waiver

Applicable if You Live In (or Are a Business with Your Principal Place of Business In) the United States. 

We hope we never have a dispute, but if we do, you and we agree to try for 60 days to resolve it informally. If we can't, you and we agree to binding individual arbitration before the American Arbitration Association ("AAA") under the Federal Arbitration Act ("FAA"), and not to sue in court in front of a judge or jury.. Instead, a neutral arbitrator will decide and the arbitrator's decision will be final except for a limited right of review under the FAA. Class action lawsuits, class-wide arbitrations, private attorney-general actions, and any other proceeding where someone acts in a representative capacity are not allowed. Nor is combining individual proceedings without the consent of all parties. "We," "our," and "us" includes Microsoft and its affiliates.

  1. Disputes Covered—Everything Except IP. The term "dispute" is as broad as it can be. It includes any claim or controversy between you and us concerning this Agreement, the Software, any advertising, marketing, or communications, any Program Services offered or sold, or your participation in the Program, under any legal theory including contract, warranty, tort, statute, or regulation, except disputes relating to the enforcement or validity of your, your licensors', our, or our licensors' intellectual property rights.

    • Mail a Notice of Dispute First. If you have a dispute and our customer service representatives can't resolve it, send a Notice of Dispute by U.S. Mail to Microsoft Corporation, ATTN: CELA Arbitration, One Microsoft Way, Redmond, WA 98052-6399, U.S.A. Tell us your name, address, how to contact you, what the problem is, and what you want. A form is available here. We will do the same if we have a dispute with you. After 60 days, you or we may start an arbitration if the dispute is unresolved
    • Small Claims Court Option. Instead of mailing a Notice of Dispute, you may sue us in small claims court if you meet the court's requirements in your county of residence (or, if a business, your principal place of business) or King County, Washington, U.S.A.
  2. Arbitration Procedure. The AAA will conduct any arbitration under its Commercial Arbitration Rules (or if you are an individual and use the Program Services (including any software) for personal or household use, or if the value of the dispute is $75,000 USD or less whether or not you are an individual or how you use the Program Services or Software, its Consumer Arbitration Rules). For more information, see adr.org or call 1-800-778-7879. To start an arbitration, submit the form available here to the AAA and mail a copy to us. In a dispute involving $25,000 USD or less, any hearing will be telephonic unless the arbitrator finds good cause to hold an in-person hearing instead. Any in-person hearing will take place in your county of residence (or, if a business, your principal place of business) or King County, Washington. You choose. The arbitrator may award the same damages to you individually as a court could. The arbitrator may award declaratory or injunctive relief only to you individually to satisfy your individual claim. Under AAA Rules, the arbitrator rules on his or her own jurisdiction, including the arbitrability of any claim. But a court has exclusive authority to enforce the prohibition on arbitration on a class-wide basis or in a representative capacity.

  3. Arbitration Fees and Payments.

    • Disputes Involving $75,000 USD or Less. We will promptly reimburse your filing fees and pay the AAA's and arbitrator's fees and expenses. If you reject our last written settlement offer made before the arbitrator was appointed, your dispute goes all the way to an arbitrator's decision (called an "award"), and the arbitrator awards you more than this last written offer, we will: (1) pay the greater of the award or $1,000 USD; (2) pay your reasonable attorney's fees, if any; and (3) reimburse any expenses (including expert witness fees, and costs) that your attorney reasonably accrues for investigating, preparing, and pursuing your claim in arbitration.
    • Disputes Involving More than $75,000 USD. The AAA rules will govern payment of filing fees and the AAA's and arbitrator's fees and expenses.
  4. Must File Within One Year. You and we must file in small claims court or arbitration any claim or dispute (except intellectual property disputes—see Section 15.1) within one year from when it first could be filed. Otherwise, it's permanently barred.

  5. Rejecting Future Arbitration Changes. You may reject any change we make to section 15 (except address changes) by sending us notice within 30 days of the change by U.S. Mail to the address in section 15.1. If you do, the most recent version of section 15 before the change you rejected will apply.

  6. Severability. If any part of section 15 (Disputes. Binding Arbitration, and Class Action Waiver) is found to be illegal or unenforceable, the remainder will remain in effect (with an arbitration award issued before any court proceeding begins), except that if a finding of partial illegality or unenforceability would allow class-wide or representative arbitration, section 15 will be unenforceable in its entirety.

  7. Conflict with AAA Rules. This Agreement governs to the extent it conflicts with the AAA's Commercial Arbitration Rules or Consumer Arbitration Rules.

Disclaimer and Limitation of Liability for the Services

MICROSOFT AND/OR ITS RESPECTIVE SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE SERVICES OR THE SUITABILITY OF THE INFORMATION CONTAINED IN THE DOCUMENTS AND RELATED GRAPHICS PUBLISHED AS PART OF THE SERVICES FOR ANY PURPOSE. ALL SERVICES, DOCUMENTS AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. MICROSOFT AND/OR ITS RESPECTIVE SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE SERVICES, INFORMATION AND RELATED GRAPHICS, INCLUDING ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, WHETHER EXPRESS, IMPLIED OR STATUTORY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. IN NO EVENT SHALL MICROSOFT AND/OR ITS RESPECTIVE SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, INCLUDING THE USE OR PERFORMANCE OF INFORMATION AVAILABLE FROM THE SERVICES.

THE DOCUMENTS AND RELATED GRAPHICS PUBLISHED ON THE SERVICES COULD INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. MICROSOFT AND/OR ITS RESPECTIVE SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE PRODUCT(S) AND/OR THE PROGRAM(S) DESCRIBED HEREIN AT ANY TIME.

IN NO EVENT SHALL MICROSOFT AND/OR ITS RESPECTIVE SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SERVICES, SOFTWARE, DOCUMENTS, PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR INFORMATION AVAILABLE FROM THE SERVICES.
